IHL & HRL Violations - August 2018

ANSAR ALLAH/HOUTHI MOVEMENT

Hudaydah Governorate

On August 14th, the Houthis kidnapped Mwatana human rights researcher Kamal Al Shawish. This violates Rule 99 of customary IHL.

Jizan, KSA

On August 8th, a Houthi missile launched into Saudi Arabia killed one and wounded eleven civilians, violating rules 3 and 6, which prohibit harming civilians.

SAUDI-LED COALITION

Sa’dah Governorate

On August 9th, a coalition airstrike struck a school bus, killing 51 people, including 40 children. The attack violates Rule 22, which requires parties to take precautions protecting civilians, and rules 3 and 6 that prohibit harming civilians. The coalition initially defended the attack as “legitimate.”

Hudaydah Governorate

On August 8th, Yemeni officials and witnesses reported that fighting in al-Hudaydah had killed 80 people over the last two days. Additionally, in al-Durayhimi, south of Hudaydah City, at least a 100 people were wounded and 30 killed in clashes between the coalition and the Houthis.

Country-wide

On August 8th, a UN report alleged that both the Houthis and the Saudi-led coalition had committed war crimes, including attacks on civilians, torture, and the deployment of child soldiers.

Hudaydah Governorate

On August 2nd, a neighborhood, fish market, and al-Thawra Hospital (the largest hospital in Yemen), were struck with mortar shells or missiles, killing 55 and injuring 170. The Houthis and the Saudi-led coalition blamed each other. Early ground reports indicated coalition involvement, while fragments of mortar munitions led the coalition to blame the Houthis, falsely alleging that they were the only ones within mortar range. These are violations of customary IHL rules 1, 3 and 6 that prohibit harming civilians not involved in hostilities.

On August 23rd, Houthi media reported that 22 children and 4 women died in al-Durayhimi as a result of coalition air strikes, while the UAE state news agency reported a Houthi missile had killed one child and injured dozens of civilians. These actions are violations of customary IHL rules 1, 3 and 6 that prohibit harming civilians not involved in hostilities.
